These Terms & Conditions ("Terms") govern your access to and use of NotifyTechAI ("we", "our", or "us"), a WhatsApp Business API platform operated at notifytechai.com for Indian small and medium businesses.

By creating an account, connecting a WhatsApp number, or otherwise using our platform, you agree to be bound by these Terms. If you are using NotifyTechAI on behalf of a business, you confirm you have the authority to accept these Terms on that business's behalf. If you do not agree, please do not use the platform.

NotifyTechAI is intended for business use only and is not directed at individuals under the age of 18. When you register a workspace, you agree to:

• Provide accurate, current registration and business details
• Keep your login credentials confidential and notify us promptly of any unauthorized account access
• Be responsible for all activity that occurs under your workspace, including actions taken by team members you invite

Every workspace has an Owner role, who holds final authority over billing, team roles, and API keys. The Owner is responsible for assigning appropriate roles (Agent, Manager, Admin) to team members and for managing their access to conversations, campaigns, and data within the workspace.

NotifyTechAI is offered on a subscription basis. Each workspace is assigned a plan that determines the number of connected WhatsApp numbers, team members, and contacts available:

Starter, Growth, and Business plans are available on monthly or yearly billing, with yearly billing priced at the equivalent of 10 months for 12 months of access. Enterprise plans are custom-priced — contact sales@notifytechai.com for a quote.

Payments are processed through our payment partner, PhonePe. We do not store your raw card or payment instrument details on our servers. Only the workspace Owner can view billing details, change plans, or initiate payments.

New workspaces start on a Free Trial, limited to 100 messages, 100 contacts, and 5 campaigns across the lifetime of the trial (not renewed monthly). Once any trial limit is reached, that resource is blocked until you upgrade to a paid plan.

Your workspace will show one of the following subscription states at any given time:

• Free Trial — your starting state, subject to the usage limits above
• Pending Payment — a paid plan has been selected but payment has not yet been confirmed
• Active — your plan is paid and in effect
• Grace Period — your subscription renewal failed or lapsed; you have a limited window to renew before access is restricted
• Blocked — the grace period elapsed without renewal. Dashboard access is suspended until you reactivate, but your conversations, contacts, and campaign data are preserved and become accessible again immediately upon reactivation
• Cancelled — you have cancelled your subscription but retain access until the end of your current billing period

You may cancel your subscription at any time from the Billing page. Except where required by applicable Indian consumer protection law, fees already paid for the current billing period are non-refundable — see our Return Policy for details on eligible refund circumstances.

You agree to use NotifyTechAI only for lawful business communication with contacts who have opted in to receive WhatsApp messages from you. You are solely responsible for ensuring your messaging practices comply with WhatsApp's Business Policy and applicable Indian regulations — NotifyTechAI does not validate contact opt-in status on your behalf.

You agree not to use the platform to:

• Send unsolicited bulk messages, spam, or messages to contacts who have not consented to receive them
• Send content that is unlawful, fraudulent, defamatory, or infringes on the rights of others
• Attempt to circumvent WhatsApp's messaging policies, rate limits, or safeguards, including those built into our platform to protect connected numbers from being flagged or banned
• Interfere with or attempt to gain unauthorized access to another tenant's data, sessions, or account
• Reverse-engineer, resell, or use the platform to build a competing product

We reserve the right to suspend or terminate access for accounts found in violation of this section, particularly where a violation risks the WhatsApp connectivity or reputation of other tenants on the platform.

NotifyTechAI connects your WhatsApp number(s) via a session-based integration. Our service depends on WhatsApp's own platform, infrastructure, and policies, which are operated by Meta and outside our control. Accordingly:

• We are not responsible for outages, delays, or feature changes originating from WhatsApp's own network
• We are not responsible for a WhatsApp number being restricted or banned by Meta due to your own messaging practices, including violations of WhatsApp's Business Policy or opt-in requirements
• Certain WhatsApp behaviours (e.g. message deletion) are only possible within WhatsApp's own standard time windows, which we cannot extend

NotifyTechAI and its underlying software, design, and branding are owned by us and protected by applicable intellectual property law. These Terms do not grant you any rights to our intellectual property beyond the right to use the platform as intended.

As between you and us, you retain ownership of the contact data, message content, campaign content, and other business data you upload or generate within your workspace ("Your Data"). We use Your Data only to provide and support the service, as described in our Privacy Policy.

We aim to keep NotifyTechAI available and reliable, and we use commercially reasonable efforts to maintain uptime and promptly address disruptions. However, we do not guarantee uninterrupted or error-free operation. Scheduled maintenance, third-party infrastructure issues, or WhatsApp-side disruptions (see Section 6) may occasionally affect availability.

To the maximum extent permitted by applicable law, NotifyTechAI and its team shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the platform, including loss of profits, business, or data, even if advised of the possibility of such damages.

Our total liability arising from these Terms or your use of the platform shall not exceed the amount you paid us for the service in the three (3) months preceding the event giving rise to the claim.

You may stop using NotifyTechAI and cancel your subscription at any time from the Billing page. You will retain access through the end of your current billing period, as described in Section 4.

We may suspend or terminate your access if: your subscription lapses beyond the grace period described in Section 4; you violate the Acceptable Use terms in Section 5; or we are required to do so by law. We will make reasonable efforts to notify you of any termination for cause.

Upon termination, your data is handled according to the retention terms described in our Privacy Policy.

These Terms are governed by the laws of India. Any disputes arising from these Terms or your use of NotifyTechAI shall be subject to the exclusive jurisdiction of the courts of Gurugram, Haryana, India.

We may update these Terms from time to time. When we make material changes, we will notify you via:

• An email to the address registered on your account
• An in-app banner visible at your next login

The "Last updated" date at the top of this page reflects the most recent revision. Continued use of the platform after the effective date constitutes acceptance of the updated Terms.
